Excavation in Delta
Ladner, Tsawwassen and North Delta: here is what Delta’s bylaws say about soil, trees and streamside work.
Local rules that affect excavation
Checked October 2026. Each point below links to Delta’s own bylaw or web page. Bylaws change, so confirm with Delta before work starts. General information, not legal advice.
Soil, roads and streams
- Soil Deposit and Removal Bylaw No. 7221 regulates soil deposit and removal on agricultural land, and Delta’s application form states that a permit is required before any soil is deposited or removed. Source: City of Delta: Soil deposit permit application
- A Highway Use Permit is required for any work within the road dedication. Source: City of Delta: Highway Use Permit
- Properties within 30 m of a stream, river, slough, ditch or pond are in the Streamside Protection and Enhancement Area Development Permit area. Source: City of Delta: Development considerations
Trees and erosion
- Tree Protection and Regulation Bylaw No. 7969 covers trees with a trunk diameter of 20 cm or more at 1.4 m; retained trees need protective barriers, and excavation next to a barrier must be done by hand. Source: Bylaw No. 7969 (PDF)
- For single-family lots, an Erosion and Sediment Control declaration must be signed before the building permit is issued, including covering all soil stockpiles. Source: City of Delta: ESC declaration (PDF)
Provincial and federal rules apply too
Municipal bylaws sit on top of provincial and federal rules: BC 1 Call locates and WorkSafeBC requirements on every dig, the Agricultural Land Commission for fill in the ALR, soil relocation notifications for some commercial and industrial sites, and the Water Sustainability Act and Fisheries Act near streams. Our Excavation permits checklist for BC projects links each one to its source.
